Claims involving government-owned vehicles are subject to sovereign immunity laws, which require a specialized “notice of claim” process. Under Florida Statute § 768.28, you must provide formal written notice to the government agency (such as the City of West Palm Beach or Palm Beach County) before filing a lawsuit. These cases also have strict damages caps of $200,000 per person and $300,000 per incident under § 768.28, F.S., and require written notice of the claim within three years of the incident, after which suit cannot be filed until the agency has had 180 days to review the claim or has formally denied it.
